I need your help, a person by the name of Jim Margo, has scammed 007 Airsoft for more than 2000 dollars within the past month, he used a credit card to make purchases from us. But approximately one month after the transaction (and after receiving all the products) he filed "unauthorized use of credit card" for all the purchases.

Now we are short a whole lot of money because Paypal decided to let the credit card company win the dispute even after I showed them all tracking number and delivery signatures. Needless to say I have already tried contacting him by email, phone, even mail. He did not response, as it is pretty clear now that he did this on purpose.

His shipping address is in the Richmond Hill area. If you think you know him or can help, please pm me.

According to the info he provided:

His e-mail is marktolisto@gmail.com and that could be his real name.

I'd involve the local PD immediately. A knock on his door might be enough to get an immediate turn around, at least a return of your items.

i dont under stand how they could side with him if you can show the shipping to him....unless he sent them to someone else..and they say someone else used ..in which case the cops should pay that guy a vist anyway!

it isn't paypal in this case, we had the same customer trying to pull this crap with us. Basically he has been using stolen credit cards and the original owners are issuing charge backs through their credit card companies.. ie: visa, mastercard etc. Paypal has no power in this situation.

So the credit card companies are fucking the retailers over instead of using their insurance coverage...? ��

That infuriates me a whole lot actually......!

That is how it has always worked. For large retailers, it doesn't affect bottom line much. But as soon as someone "disputes" a charge, the power goes back to the person disputing. Visa, mastercard, Amex ect became large because they aren't in the business of giving out free money.

If a charge is disputed, somebody pays. Unfortunately small retailers are frequently hit hardest. People who commit CC fraud like this are scum.


On Topic, Ken what was scammed? Maybe people can keep there eyes open for a "too good to be true this fell off a truck" deal on the items.

Yeah, may be a good idea to let people know what to keep an eye for.

Also, contact York Regional Police. They won't like the idea of a scammer having realistic looking guns.

Get in touch with the other retailers in the GTA. Toronto police and York Police won't prioritize the fraud if it's under $5000 thanks to the court system.

If you have the credit card number, call the financial institution's customer service line and ask for either the visa card risk department and inform them that these credit cards were used in a scam.

The Financial Institution will already have a record of the lost credit cards but when you report it to them with a police report on hand their corporate security department will step in and work with police to track them down.

This is where it gets tricky.

IF you want to get your money back, you need to get proof from the police that the scumbag did the transactions online. Then present this evidence at small claims court to be possibly get your money back. Police will not reimburse you for your money so speak with your FI and financial advisors about what they can do to ameliorate this loss.

Fraud is often called theft with a smile so if I'm right, this guy probably is unemployed and does this for a living. It's a credit card so the fraudster has no money and if you try to sue him he will have no way of paying you guys back.

Hopefully I am wrong, if not, I am very sorry...

Small claims court or a dark alley and a baseball bat are your only recourse. York won't do anything but if you do have his information you can go to court. It will cost you time and a filing fee, plus you will need to have him served. You could also go another route... and that is a private complaint filed with the Ontario courts. It is a recourse when the police choose not to do the work. The crown is obliged to hear the allegation in front of a justice of the peace and they can issue a summons for him to appear and will prosecute the case. This won't get your money back usually but it will get you satisfaction and him a criminal record.

Sorry to sound like the bad guy but you may have to swallow this one.... or take a bat to the location and get your stuff back.

I work for the bank and i will keep it simple. The banks are in it to protect the Customer i.e. end user and not the retailer. If you take the flip side, how many times has a retailer screwed over the end consumer? (not saying you guys are bad i have purchased thing from you and it was amazing) there are more instances of the Customer getting screwed then the retailer hence your not really protected at all.

It sounds like, for you, he used his own card and but filed a dispute with the bank / CC company after the statement came out and claimed fraud on his account. At this point the person who was assigned to investigate his claim deemed it fraud, and the bank went after the money. (yes investigators are idiots)

after that a variety of thing may happen to close the case, but as for recorse you my not have any.

If you really want i can ask and find out can you dispute the dispute but i dont think so.
